New Lawsuit on Obamacare

U.S. Citizens Association filed a lawsuit to overturn the new healthcare law.  In a press release, the USCA said:

“The U.S. Citizens Association has assembled a team of constitutional litigators to launch a full-scale legal war against the Obama administration’s health insurance reform legislation, known as the Patient Protection and Affordable Care Act. . . . It has hired three law firms to make the case in Federal Court that the new law violates protections afforded by the Bill of Rights to Americans.”

David Kopel of The Volokh Conspiracy says this about the new lawsuit:

“What makes the lawsuit significance is a well-developed argument . . . on medical privacy issues.”

Why the Personal Mandate to Buy Health Insurance Is Unprecedented and Unconstitutional

A scholarly article dated December 9, 2009, article by Randy Barnett , Nathaniel Stewart and Todd Gaziano called “Why the Personal Mandate to Buy Health Insurance Is Unprecedented and Unconstitutional.”  Here is the summary of the article:

“A mandate requiring all individuals to purchase health insurance would be an unprecedented form of federal action. The government has never required people to buy any good or service as a condition of lawful residence in the United States. An individual mandate would have two features that, in combination, would make it unique. First, it would impose a duty on individuals as members of society. Second, it would require people to purchase a specific service that would be heavily regulated by the federal government.”

Reconciliation Bill Adds Even More Taxes

The Heritage Foundation:  “The reconciliation bill adds even more taxes for Americans — an estimated $52.3 billion over 10 years, according to a new analysis from Americans for Tax Reform. . . . Heritage’s Robert Book, Guinevere Nell and Paul Winfree have been documenting these tax changes, noting how the legislation imposes new taxes on employers, the sick, and low-income and moderate-income workers.”  The new taxes include, medical devices, prescription drugs, health insurance, “cadillac” tax on high premium health plans, and a tax on employees from low income families.

Healthcare Changes that Will Begin in 2010

Bloomberg has a story about the Obamacare changes that will begin in 2010.  The tanning industry must have some enemies in Congress because it was singled out to have the dubious honor of being liable for a ten percent tax on tanning that starts in July.  See “Health-Care Changes to Start Taking Effect This Year” for more provisions that take effect in 2010.
